CCTV captures assault on senior citizen

Rashid Ali, SHO of Sector Phase-II PS, said, "The NCR has been lodged according to the complaint we received. The crime happened outside the house, but they wanted a case under sections 452 (house trespass) and 307 (attempt to murder) just because the victim is a senior citizen. The accused, who are in their late twenties, allegedly fought with Chibber over wrong parking on January 13.

Noida: CCTV footage of two men attacking a senior citizen in Sector 93A has come to light, but there has been no action yet against the accused.TOI reported that Subhash Chandra Chibber (75) was beaten up by brothers Lokesh and Kunal Garg on March 16 after he complained to their mother about their misbehaviour. The accused, who are in their late twenties, allegedly fought with Chibber over wrong parking on January 13. All of them are residents of ATS Greens Village in Sector 93A.According to a complaint filed by Subhash's wife Aarti (69), he had reached the tower where his flat is located when three people started beating him up. The complainant has named Lokesh Garg, Kunal Garg and their driver. In the footagethe three can be seen pushing Subhash to the ground several times and beating him up. When his family members and a security guard try to intervene, one of the accused starts quarrelling with them while the others assault him mercilessly.Subhash's nephew, Rajesh Chibber, said they were not satisfied with the police's action in the case. "My uncle signed a compromise letter under pressure from the RWA and other senior citizens. The police lodged a non-cognisable report (NCR) instead of an FIR, and that too under weaker sections of IPC to hush up the matter. The accused has not been picked up by the police for interrogation despite the complaint being lodged," he said, adding that the accused held high positions in a property consultant company and were influencing the case. Rashid Ali, SHO of Sector Phase-II PS, said, "The NCR has been lodged according to the complaint we received. I have done what is lawful."The NCR has been registered under sections 323 (causing hurt), 504 (intentional insult with intent to provoke breach of peace) and 506 (criminal intimidation). In an NCR, no arrests are made without a warrant and the investigation cannot be initiated without a court order, while in an FIR, the police carry out an investigation. The two brothers were produced before a magisterial court on Monday where they deposited a challan fee and were let off. Lokesh Garg said Subhash had misbehaved with his mother and that was why they had attacked him.
