AGRA: Following a weeks-long investigation, Uttar Pradesh police on Wednesday added the stringent Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015 in the FIR registered against Tripti Tyagi, the teacher who had asked classmates to slap an eight-year-old boy from the minority community, while making alleged communal comments. After the incident which happened at a school in Khubbapur area of Muzaffarnagar last month, the teacher had been charged under sections 504 (intentionally insulting someone to provoke them) and 323 (related to voluntarily causing hurt) of the IPC. Legal experts said that both these sections do not entail stringent punishment, unlike Section 75 of the Juvenile Justice Act (pertains to person having control of child, assaults, abandons, abuses or willfully neglects the child). "An individual charged under Section 75 of the JJ Act could face imprisonment for a maximum of three years," special public prosecutor, Dinesh Sharma, said.Deputy superintendent of police, Khatauli, Ravi Shankar Mishra, said that "it was decided to add the section of the Juvenile Justice Act after detailed investigation was conducted in the matter." The video of the incident showed Tyagi apparently instigating other students to physically assault the boy.
