Gujarat HC reserves order on demolition of illegal construction at Sanjiv Bhatt's bungalow

A division bench of the Gujarat HC, headed by Chief Justice R Subhash Reddy, has reserved its order in connection with a petition that had challenged the demolition of the alleged illegal construction at former IPS officer Sanjiv Bhatt's bungalow. Jeet Bhatt, counsel for petitioner Shweta Bhatt, wife of Sanjiv Bhatt, argued that the AMC had taken the decision in an arbitrary manner, without hearing out the petitioners. The matter pertains to a petition that was filed way back in 2012 by one of Bhatt's neighbour, Pravinchandra Patel, who had sought demolition of alleged illegal construction within the compound walls of Bhatt's bungalow. The bungalow is jointly owned by Sanjiv Bhatt and his wife. Before the division bench granted a stay, a single judge bench of AJ Desai had asked the civic body to implement its order to demolish the illegal construction within a week.

Earlier, the cop had secured a stay against the demolition at his bungalow in Sushil Nagar Society, in the Drive-in area of the city. Jeet Bhatt, counsel for petitioner Shweta Bhatt, wife of Sanjiv Bhatt, argued that the AMC had taken the decision in an arbitrary manner, without hearing out the petitioners. The bungalow is jointly owned by Sanjiv Bhatt and his wife. Before the division bench granted a stay, a single judge bench of AJ Desai had asked the civic body to implement its order to demolish the illegal construction within a week. The matter pertains to a petition that was filed way back in 2012 by one of Bhatt's neighbour, Pravinchandra Patel, who had sought demolition of alleged illegal construction within the compound walls of Bhatt's bungalow. Patel had moved a petition after the AMC in two separate RTIs admitted that the construction at Bhatt's bungalow was unauthorised, yet did not make any move to pull it down. Patel had, at that time, alleged that Bhatt had made the construction without leaving adequate space between both the houses.
