Bill to ease redevelopment process of building in Gujarat Assembly soon

The Gujarat government is going to table a Bill to ease the process of redevelopment of buildings in the upcoming monsoon session of assembly. Recently, the government had issued an ordinance against chain snatching act making the provision of 10 years imprisonment and fine of Rs. The government has decided to simplify the process of redevelopment of the decayed or dilapidated structure of housing colony having apartments. The government mentioned in the Bill that redevelopment or reconstruction of the old buildings are not possible sometimes as the total consent of occupants of buildings is required. The government will also bring the bill to establish a world class biotechnology university near Gandhinagar and a bill amending the GST Act after the change in slabs of the taxes decided by the GST Council in recent past.

The Gujarat government is going to table a Bill to ease the process of redevelopment of buildings in the upcoming monsoon session of assembly. The two days session of assembly has been called on September 18 and 19. The House follows proceedings on five such Bills, including the formation of the commissioner for municipalities, the law against chain snatching cases, revision in GST tax rates, the formation of biotechnology university and others. The government has decided to simplify the process of redevelopment of the decayed or dilapidated structure of housing colony having apartments. The Bill will suggest amendment in Gujarat Ownership Flat Act, 1973 and the required consent from housing unit owners will be made 75% of total owners against present provision of 100%. The government mentioned in the Bill that redevelopment or reconstruction of the old buildings are not possible sometimes as the total consent of occupants of buildings is required. It is therefore contemplated to remove such provision and replace it with the provision for redevelopment or reconstruction should be made after consent received from not less than 75% of total occupants. The government also added the clause in the act that buildings to be redeveloped or reconstruction should be 25 or more years or else the tenure of 25 or more years should have been completed after the development permission given by competent authority. The competent authority shall have to certify the building as dilapidated or decayed which could be harmful for its occupants, residents or users, buildings or properties nearby that building or the passers-by. The government is also going to table the bill making the laws against chain snatching more stringent. The bill will suggest amending the article 379 of Indian Penal Code(IPC) in which two sub-section of provision of sentence against such act will be amended. Another bill forming the commissioner for the municipality in state replacing the system of Directorate of municipalities also will be tabled in the session. The government has already made the appointments of the commissioner and subordinate officials and staff in the authority and now the bill to give a legal entity and more power to authority will be brought. Recently, the government had issued an ordinance against chain snatching act making the provision of 10 years imprisonment and fine of Rs. 25,000 as punishment to the convict. The same provisions will be added in the subsection of article 379 of IPC. The bill will be sent to the central government for presidential assent as it suggests amendment in central law. The government will also bring the bill to establish a world class biotechnology university near Gandhinagar and a bill amending the GST Act after the change in slabs of the taxes decided by the GST Council in recent past. The government had prepared to bring the bill on exempting the people with leprosy from action against begging act, but that has been withdrawn.
