Expressing remorse gets tipplers less punishment

AHMEDABAD: Jayshril Parmar was caught drunk driving three years ago by city police and tested positive. For many tipplers who were caught drunk and booked under prohibition laws, their expressing “remorse” bailed them out with fine and a day’s ‘term’ in courtroom. He too got away with a day’s stay in court and Rs 1,500 fine after seeking leniency with folded hands. He was facing jail term up to six months but got away with punishment of sitting one-day in courtroom.The reason behind his getting away with milder punishment for violation of prohibition laws in dry Gujarat and for drunk driving was that he expressed intense remorse for his gesture. This was because Parmar admitted his guilt voluntarily, pleaded before the court to show leniency towards him because it was his first offence.

He was facing jail term up to six months but got away with punishment of sitting one-day in courtroom.The reason behind his getting away with milder punishment for violation of prohibition laws in dry Gujarat and for drunk driving was that he expressed intense remorse for his gesture. He promised the court that he would never drink again and take to the wheel in inebriated condition.The metropolitan court ordered Parmar to sit in courtroom until court completed its day’s work. He was ordered to pay Rs 1,500 fine. This was because Parmar admitted his guilt voluntarily, pleaded before the court to show leniency towards him because it was his first offence. If he was put behind bars, his family would face financial troubles.Interestingly, the court accepted the offender’s request also because Gujarat high court’s recent provisions to reduce pendency and to speed up cases. The court noted that the high court is striving hard, special meeting was arranged to trace out old cases and instructions were issued to dispose them of. Getting rid of pendency also seemed to be weighing on court’s mind in handing down milder punishment.Hardik Rameshbhai’s case was no different, when he got away last week with Rs 500 fine and sitting in courtroom till the court’s work got over for the day. In inflicting mild punishment on him, the metropolitan court observed that it would not be appropriate to send him to jail or impose heavy fine, for his family would suffer. He too expressed regrets for the offence and promised the court not to repeat the offence.The court also said that it would not be proper to be keen on exercising full powers and becoming “too technical” in such a matter.Gambhirsinh Vaghrola was waiting for his trial since 2007. He too was caught driving in inebriated condition. He too got away with a day’s stay in court and Rs 1,500 fine after seeking leniency with folded hands. Sunil Rathod was fined Rs 200, Devang Vaishnav who was booked in 2001 got to pay Rs 1,000, Vigu Talpada paid Rs 500 and Hasmukh Kanad got away by paying Rs 300.
