Surat Customs department to start attaching Nirav Modi’s assets

The Surat customs department will begin the process of attaching properties of fugitive diamond merchant Nirav Modi, after he failed to appear before Surat district Chief Judicial Magistrate Court, on Thursday, which was the deadline prescribed while declaring him absconder under CrPC Section 82. The court had on October 10 acted on the application of the Surat Customs department, and declared Nirav Modi as an absconder. In the court’s order, it was mentioned that Modi should remain present in the court on November 15. Sources said that as per the legal provisions, the Surat Customs department officials will soon submit an application before the Surat district Chief Judicial Magistrate Court to seek permission to attach his properties. If the court permits, the Customs department will identify his properties in Surat and in other parts of the country as well and start attaching them. The Customs department in Surat had registered an offence against Modi and his firms – Firestar Diamond International Pvt Ltd, Firestar International Pvt Ltd, Radhasir Jewellery co pvt. Ltd – under sections of 135 (1) (A)(I), section 135(1),(B)(I), 132 and section 140 of Customs Act 1962. An arrest warrant order dated June 22, 2018 under section 70 of CrPC was also issued against him. DRI officials in Mumbai had seized export consignments of three diamond and jewellery firms of Modi from Surat Hira Bourse in Mumbai on December 5, 2014. The three firms of Modi through which exports were shown are Firestar International Diamonds Limited, Firestar International Private Ltd and Radhashir Jewellery, all located at Special Economic Zone (SEZ) at Sachin in Surat. Modi had violated the norms of SEZ by selling the imported high-quality polished diamonds in the local domestic market and had exported low- quality diamonds-studded gold jewellery.
