Joyride contract: Ahmedabad civic body silent on cancellation

Forty-eight hours after the tragic joyride collapse at Kankariya that claimed two lives, city mayor Bijal Patel on Tuesday said that it is up to Road and Buildings (R&B) Department to cancel its safety certificate, while the police can cancel its license. However, she was silent on whether Ahmedabad Municipal Corporation (AMC) will cancel the contract for the joyride. "The Safety Certificate was awarded by R&B department, while the license to operate was given by the police. They can cancel their certificate and license if the conditions are not followed. Since AMC has no role here, it cannot cancel the license or the certificate," Patel told DNA. The Safety Certificate is a one-time certificate required for installation of the ride while police license is required to do away with law and order issues. However, since the land belongs to AMC and it had entered into a contract with private operator Ghanshyam Patel for the ride in Kankariya, which collapsed on Sunday killing two persons and injuring 29, the liability lies with the civic body too. When asked whether AMC is willing to terminate the contract, she said that FIR has been filed and accused have been arrested. "The director of Kankariya Lakefront has informed respective authorities that they can cancel their nods," said Patel. City police commissioner A K Singh said that a lot of systemic flaws have come to light in this case. The police issue a premise license based on the certificate by R&B department and NOC from the fire department. Both the authorities periodically renew the certificate and license every year. While the responsibility of the police is to award a license and renew it every year, R&B is supposed to inspect it periodically (every year). "In this case, the day to day maintenance and operation is based on a license of the lease agreement between the AMC and the contractor. The responsibility of maintenance, regular operation, periodic inspection, keeping technical people onsite and ensuring compliance of all the norms prescribed in the license condition is based on the agreement between the authority and the licensee," said Singh. State Congress spokesman Manish Doshi said that the Safety Certificate by R&B is a one-time certificate, but after that, it is the duty of the civic body to conduct security checks periodically. "Moreover, it is AMC that has awarded the contract and it is its duty to ensure compliance. By bringing the R&B department and police in the picture, AMC is trying to avoid its responsibility," said Doshi.
