HC relief for SRK in Vadodara accident case

The high court on Thursday stayed court proceedings against Bollywood star Shah Rukh Khan in the case pertaining to the fatal accident that took place at Vadodara railway station on January 23 when Khan had halted there to promote his film ‘Raees’. This is the film star’s second quashing petition. In the present petition, he had challenged the summons issued by the judicial magistrate first class-Vadodara on Monday directing him to appear before it. The actor had sought a stay on court proceedings while the petition is pending for decision. Shahrukh Khan’s advocate Salil Thakore and senior counsel Mihir Thakore submitted, “The actor was on his way to Delhi to promote his film. As news had spread in advance, his fans had turned up in large numbers at the Vadodara railway station. When the train stopped, the actor came to the footboard of the coach and waved. He also flung across some T-shirts and soft balls onto the frenzied crowd. This created a commotion among fans, resulting in the death of a man.” The petition was vehemently opposed by public prosecutor Mitesh Amin, who submitted that being a celebrity he should have acted with caution while throwing T-shirts and soft balls. He said earlier the high court had entertained his petition staying summons issued by the police to record his statement. Later, the executive magistrate conducted an inquiry and summons was issued to facilitate court proceedings. He further submitted the petition should be rejected. After hearing both sides, single bench justice AJ Desai granted relief to the actor and stayed court proceedings till September 25. He has issued a notice to the state directing it to file a reply before the next hearing. The case On January 23, Shahrukh Khan and his co-star had boarded the August Kranti Express from Mumbai to Delhi to promoted 'Raees'. With the train have a stoppage at Vadodara, there was a huge turnout of fans at the railway station. In the melee, a man called Fareed Khan Pathan fell unconscious and later died. Following the incident, the Railways appointed a committee to probe overcrowding at the railway station. Two persons had given applications to the railway police demanding action against the star for Pathan’s death. Vadodara railway police had also issued summons to the actor to appear before it so that it could record his statement, but Khan did not do so. Tail piece As soon as hearing on SRK’s petition ended, and the court was hearing another quashing petition, the cellphone of a visitor started ringing. The ring tone happened to be ‘Tujhe dekha to ye jana sanam’, a song from his old hit DDLJ. The judge good humoredly said, “It is now SRK’s song”, sparking off laughter in court room No. 12.
