JAIPUR: The state government has decided to file a Special Leave Petition (SLP) in the Supreme Court challenging the high court order on master plan The government had constituted a high-power committee to examine the order of the court on a PIL by Gulab Kothari. The court had given 35 directions in its order on January 12, 2017. The decision of the government is based on the recommendation of the high-power committee.Sources said that three points in the order will be challenged in the apex court are namely, the abolition of compounding provision for violation of building bylaws, restoration of ecological zone, and restoring the land use change of the facility areas as per master plan.The meeting chaired by principal secretary UDH Bhaskar Sawant, was attended by chief town planner R K Vijayvargiya, officials of the UDH, revenue and legal department.The court asked the government to abhor the practice of regularizing illegal constructions by paying a penalty for illegal constructions (compounding). The court had also come down heavily on the government for regularizing buildings on ecological zones and at facility areas.The government is of the view that the implementation of the order of the court involves large-scale demolition.Master plans have been prepared for Jodhpur, Kota, Bikaner Ajmer and Udaipur cities, in which, certain places have been reserved as 'Green Belt Areas' (also known as peripheral control belt) for public amenities. But the land use of areas reserved in the master plans have been changed by the committee constituted by the state government under Rajasthan Municipalities (Change in Land Use) Rules, 2000, based on the recommendations made by the local bodies.
