Allahabad High Court orders immediate release of Dr. Kafeel Khan, revoking all the orders implied under the National Security Act

In major relief of Dr. Kafeel Khan the Allahabad High Court on Tuesday ordered his immediate release and order for drop of stringent National Security Act charges that were imposed upon him over an alleged inflammatory speech by him against Citizenship Amendment Act

Dr. Kafeel was arrested in January for delivering speech at Aligarh Muslim University on December 10 2019 against the controversial law of CAA and NRC, the NSA charges were invoked on him on February 13 2020 on the orders of Aligarh District Magistrate and on August 16 his detention under NSA was extended for the second time in three months, incidentally his also comes on the day of his wife Shabista Khan’s birthday ‘’It is the best birthday gift I have ever received’’ she stated. He was booked under IPC section 153A (promoting enmity between different groups on ground of religion) and later section 153B (imputations, assertions prejudicial to national integration) and section 502(2) (statements creating or promoting enmity, hatred or ill will between classes ) were also added to the FIR 
The HC also declared the extension of detention period as illegal. Several appeals for Dr. Kafeel Khan were made by his family members and other activist on social media, recently he also wrote a letter about the conditions of the prison in Mathura, the four page letter drafted by him with his hands spoke of the ‘’hellish’’ conditions of his barracks, where 150 inmates were sharing a toilet. 


Earlier in March when swathes of COVID-19 cases were emerging and affecting masses across the world he had written to Prime Minister Narendra Modi requesting to be allowed for medical expertise to help fight the pandemic ‘’I have conducted 103 free medical camps since out of jail after the BRD oxygen tragedy examining over 50,000 children/ patients all over India I feel I could be of some help in curtailing this disease’’ he had written. The death of nearly 60 children at the state run BRD hospital in Gorakhpur due to oxygen shortage was the hour of decision that put Dr Khan on unmitigated footing he was charged with medical negligence and dereliction of duty but absolved after two years he spent nine months behind the bar during that period
