Apex court relief to tribal medical course aspirants, asks HC to decide by July-end

Aurangabad: The Supreme Court recently ordered the schedule tribe candidates, aspiring to enroll in medical colleges and were facing difficulties involving caste certificates, to approach the principal bench of the Bombay high court. The candidates who have got certificates of validity by virtue of high court order be admitted and the vacant seats can be filled up from amongst the student who have got the certificate of validity. The medical council of India shall intimate this order to the concerned educational institution.”The court also passed directions asking the persons aggrieved by the order of the scheduled tribe caste certificate scrutiny community to approach high court by July 15. They had pointed out that a large number of claims were pending and that they could lose the opportunity of getting admission in the seats reserved for the schedule tribe category at all India level and in the state of Maharashtra.The high court, citing the Supreme Court verdict on June 13, refused to intervene in the ongoing admission process.

The apex court has urged the HC to dispose of all the petitions by the end of this month.The SC bench comprising Justices D S Bobade and L Nageseswara Rao has also asked the advocate general and his associate to remain present in the high court on the date of hearing.A number of candidates belonging to the scheduled tribe categories had approached the high court bench in Aurangabad, seeking directions to the scheduled tribe caste verification committee and other authorities concerned to ensure they get benefit of reservation in the matter of education in observance of the policy framed by the state government in time. They had pointed out that a large number of claims were pending and that they could lose the opportunity of getting admission in the seats reserved for the schedule tribe category at all India level and in the state of Maharashtra.The high court, citing the Supreme Court verdict on June 13, refused to intervene in the ongoing admission process. However, the high court had also observed that “considering the facts of this case, in order to advance the cause of justice and, since it is noticed that the petitioners are not at all at fault and they are being deprived of their entitlement to secure admission on merit, certain arrangement, as suggested by the state government and DMER, can be made.”Aggrieved by the high court verdict, Nagraj and others had approached the Supreme Court through lawyers including Sudhashu Chaudhari and Anil Golegaonkar.The apex court bench comprising Justices S A Bobade and Justice L Nageswara Rao, in its order on July 9, requested chief justice of the Bombay HC to constitute a bench to hear the matters and assign cases to the said bench so that uniformity is maintained.The SC ruled, “All the cases shall be heard at the principal bench in Mumbai. The admission shall take place within a week after the judgement is pronounced by the high court and the date of admission is extended to that date. The candidates who have got certificates of validity by virtue of high court order be admitted and the vacant seats can be filled up from amongst the student who have got the certificate of validity.
