HC relief for girl who was denied admission over misspelt surname

The claim of the petitioner for admission to medical course has not been considered by the authorities citing that on the date prescribed for document verification, she was not possessing the corrected caste certificate and validation certificate indicating the correct surname of the petitioner. The typographical mistake was noticed at a later stage, following which she move an application to the sub divisional officer for issuance of corrected tribe certificate and after securing the corrected tribe certificate, she approached to the scrutiny committee for issuance of validity certificate indicating the correct surname.The petitioner is in receipt of the corrected certificate of validity, dated: July 3, 2018. She has been ranked at 1,25,718 in the National Eligibility Cum Entrance Test (UG) in the merit list.The lawyer informed that girl student’s ST category rank is 1,850 and is willing to take admission in medical course as against the seat reserved for the category.The petitioner was issued the caste certificate and validity certificate, wherein her surname was wrongly recorded as Kharwade instead of Kharode. Aurangabad: The Aurangabad bench of the Bombay high court has come to the rescue of an 18-year-old girl belonging to scheduled tribe category, who was denied admission in MBBS course after a spelling mistake was found in her surname mentioned on the caste certificate.The authorities, citing the discrepancy during the verification of her documents, barred her from participating in the first round of MBBS admissions under the reserved quota. Unhappy with the move, she moved the HC, which issued directives asking the authorities to consider her for second round of admission.While disposing of the petition on the very first hearing, the division bench of the HC comprising Justice RM Borde and Justice AM Dhavale ruled that “since the petitioner is in possession of the validation certificate, her claim for getting enrolled in medical course deserves to be considered during the second round of the admissions.”The HC has issued specific directives to the directorate of medical education, Government dental college and hospital building, Saint George hospital Mumbai, and to the commissioner of the state common entrance test cell to consider the claim of the girl student for admission to medical course as against the seat reserved for ST category during the second round of admission, which is scheduled for later this month.Representing the girl student, lawyer Vijay Patil and Malhari Khokle contested that the girl student identified as Pallavi Kharode hailing from Kalamnur of Hingoli, belongs to Andh, a scheduled tribe.
