HC reprimands MP, says police did not act fairly

AURANGABAD: While granting bail to the activists of Maratha Kranti Morcha arrested on the charges of attempt on the life of Dhule BJP MP Heena Gavit during a protest, a division bench of the Bombay high court reprimanded the MP for failing to handle the situation responsibly. The high court also observed that the police did not act fairly.On August 5, Gavit was leaving the Dhule district collector’s office in a car when around 25 people attacked her vehicle. Some of them even climbed on the roof of the car. The video of the incident had gone viral.Following the incident, the woman MP lodged a complaint, alleging that the suspects caused damage to her vehicle and their act had put her life in danger. In her complaint, she mentioned that she knew Amol Marathe who was present in the crowd and they knew that she belongs to Scheduled Tribe category. Based on the complaint, the Dhule City police registered an offence and booked the suspects for attempt to murder, using criminal force to deter a government employee from performing his official duty, rioting and unlawful assembly. Sections of Atrocities Act and Maharashtra Police Act were also slapped on them.Gavit, in her supplementary statement recording on August 31, had named an NCP corporator and others, claiming that she was targeted as her father had left NCP and joined BJP. During the investigation, 22 accused were arrested, out of which 18 were granted bail by the lower court. The remaining suspects then moved an application before the high court.While granting them conditional bail, the division bench of the high court, comprising Justice TV Nalawade and Justice Vibha Kankanwadi, observed that “things were exaggerated and an attempt was made to show that it was bid on the life of a Member of Parliament. It is unfortunate that even when the first informant is an MP, she did not handle the situation responsibly”.The court observed that it can be said that police also had not acted fairly and unnecessarily mentioned Sections like 307 (attempt to murder) of IPC. “Due to all these circumstances, this court holds that the learned Judge of Special Court has committed an error in refusing bail to the present applicants.”
