HC fines PI Rs 75,000 for parading man with garland of shoes

Aurangabad: The Aurangabad bench of the Bombay high court (HC) has fined a senior police inspector Rs 75,000 for publicly parading a suspected thief half naked after forcing him to wear a garland of shoes in Paithan in 2015.Citing that “no civilized nation can permit this to happen”, the bench said that such a “precious right as Article 21 (the right to life and personal liberty) cannot be denied except according to the procedure established by law”.Lawyers Monica Dahat and R B Ade, who represented Somnath Gorakh Jadhav (31), approached the HC in February 2016 claiming compensation for custodial violence, police atrocities and illegal detention by inspector Chatrabhuj Kakde. Jadhav had also lodged a complaint with the National Human Rights Commission (NHRC), which slapped a fine of Rs 25,000 on Kakde. The inspector is currently posed in neighbouring Jalna district.The division bench of the HC comprising Justice R M Borde and Justice Mangesh Patil set a deadline of four weeks for compliance of its orders.Jadhav’s lawyers had contested that on June 14, 2015, a case of theft had been registered against him for allegedly stealing Rs 33,000 from a man’s pocket while visiting a local temple. He was arrested the same day and the court remanded him in police custody till June 17, during which his relatives were made to pay Rs 30,000. Later, a bogus panchnama was prepared and the amount was shown to have been recovered from Jadhav, the lawyers said.Jadhav’s custody was extended till June 20. On June 19, Kakde took Jadhav out of the police station and publicly paraded him half naked along the streets of Paithan after garlanding him with footwear and currency notes. Jadhav got conditional bail the next day, but was not allowed to leave the police station till 8pm.In keeping with the bail conditions, Jadhav regularly reported to the police station for three months. However, after that period, he was allegedly framed in another case. This time, his sister reached out to the police and tried reasoning with them. She alleged that she was abused on caste lines.Jadhav and his sister filed a complaint with the NHRC, following which a departmental inquiry was carried out by SDPO Chandrakant Alsatwar. Kakde was found guilty of parading Jadhav and illegally detaining him after he had been given bail. The report was submitted to the range special inspector general, who served a showcause notice to the inspector.Kakde’s contention that the allegations were false failed to impress the HC.
