HC relief to ZP teacher accused of forgery

The education officer in Amravati gave Tidke a no-objection certificate for inter-district transfer from NT-D category on September 11, 2017. The education officer at the zilla parishad had lodged a complaint against Tidke for forgery and hacking into the mail of the secretary to ensure his posting at Latur. Tidke was suspended on September 3, 2018.The education officer also lodged a complaint with Latur police against Tidke under 491, 420, 465, 471, 409 of the IPC as well as provisions of the Information Technology Act, 2000. Later, he was posted at Bhulori in Dharni taluka on January 21, 2010. The teacher, who got anticipatory bail from Latur sessions court, approached the high court through lawyer Ramrao Biradar seeking to quash the FIR.Following the petition, the bench comprising Justices S S Shinde and R G Avachat issued notices to the CEOs and education officers of Amravati and Latur districts on February 1.

Aurangabad: The Aurangabad bench of the Bombay high court has directed police not to file a charge-sheet without its permission against a suspended primary school teacher in Latur zilla parishad (ZP) who is accused of hacking into the mail of the government department secretary with regard to his posting in Latur.Dnyaneshwar Tidke (36), a resident of Kunki- Patoda in Jalkot of Latur district, was transferred from Amravati district to Latur district in July 2018. The education officer at the zilla parishad had lodged a complaint against Tidke for forgery and hacking into the mail of the secretary to ensure his posting at Latur. The teacher, who got anticipatory bail from Latur sessions court, approached the high court through lawyer Ramrao Biradar seeking to quash the FIR.Following the petition, the bench comprising Justices S S Shinde and R G Avachat issued notices to the CEOs and education officers of Amravati and Latur districts on February 1. It also directed Latur investigation officer to proceed with the investigation but not file a charge-sheet without seeking leave of the court till the next date (February 28).Biradar said to the court that petitioner Tidke was appointed as the Skhikshan Sevak at Bijudhwadi village, Amravati district on October 28, 2003 from the Nomadic Tribes-D (NT-D) category. Later, he was posted at Bhulori in Dharni taluka on January 21, 2010. Accordingly, Tidke submitted an online form, where he also enlisted his 14 years tenure in Amravati district, for inter-district transfer from Amravati to Latur from NT-D category on February 17, 2018Following the online submission, a list of teachers was prepared and published on May 10, 2018 where in Tidke’s name appeared at serial no. 4. Chief executive officer of Amravati relieved him on May 21, 2018 and block development officer of Dharni relieved Tidke on May 22, 2018.The petitioner said that on May 28 and June 6, 2018, the chief executive officer of Latur had shot a letter to the undersecretary of village development and water conservation department, Mantralaya seeking guidance in respect of 10 teachers who were sent to Z.P. Latur stating that their NOC under NT-D category was wrong and that “they are not entitled for absorption.” He further pointed out that the desk officer at Mantralaya had written to the CEO on July 11, 2018 stating that the category and NOC of petitioner was correct.However, the education officer accused Tidke of hacking into the email of the village development department and said he submitted a concocted letter regarding his transfer. Tidke was suspended on September 3, 2018.The education officer also lodged a complaint with Latur police against Tidke under 491, 420, 465, 471, 409 of the IPC as well as provisions of the Information Technology Act, 2000.
