Bamu senate polls challenged on technical grounds

Aurangabad: The election to the senate of Dr Babasaheb Ambedkar Marathwada University (Bamu) for the graduate category in December 2017 has been challenged legally by one candidate on technical grounds.In a petition filed before the Aurangabad bench of the high court, Hanumant Gutte has raised question over the outcome of the election, stating that the winning candidate Sanjay Kalbande had not submitted a non-creamy layer certificate, along with his nomination form. Kalbande got elected on a seat reserved for DT (VJ)/NT category.Admitting the petition, a two-member bench of justices Prasanna Varale and Vibha Kankanwadi has issued notices to Bamu and the winning candidate among other respondents, seeking their reply before April 8.As per the election programme, the list of validly contesting candidates was published by Bamu registrar, who was an ex-officio returning officer, on November 19, 2017, and the polls were held on December 4, 2017.“At the very outset of the process, the petitioner had highlighted that Kalbande had not submitted a non-creamy layer certificate. Despite his objection, the authorities released the list of contesting candidates without deciding the objection petition,” advocate Shirish Kamble, representing Gutte, said.He said Gutte had also made an application to the governor, who is the ex-officio chancellor of state universities, requesting to look into the issue.“Both Bamu administration and the office of the chancellor did not pay any heed to our complaint despite repeated communications, forcing the petitioner to knock the doors of the court,” Kamble said.Gutte has cited the reference of high court case of Aishwarya Patil Vs State of Maharashtra, in which it was said to have established that the candidates cannot take benefits of reserved seat unless and until they submit non-creamy layer certificate.Gutte has urged that the result of the election in question may be quashed.The matter is scheduled to come up for hearing before the court on April 6.
