Heera Gold MD gets bail after cops fail to file chargesheet in time

Due to a similar delay in filing of chargesheet in an offence registered against her at Pune, the court there too granted her bail on Tuesday, said her lawyer Abhaysinh Bhosale. Hearing of the case registered in Malegaon has been listed for hearing on February 16. Nowhera is currently in jail at Tirupati.Taking serious cognizance of the delay in the filing of the chargesheet, the court at Aurangabad has sought an explanation from the EOW in eight days. The matter is pending in the apex court. Aurangabad: Nowhera Shaikh, managing director of Heera Islamic Business Group (HIBG), popularly known as Heera Gold, was granted bail by a local court here on Wednesday after the economic offences wing of the Aurangabad city police failed to file chargesheet within the stipulated time of 60 days.Shaikh has police cases in Pune, Thane, Byculla (Mumbai), Malegaon in Nashik, Hyderabad, Kochi, Chittod and Tirupati.

Aurangabad: Nowhera Shaikh, managing director of Heera Islamic Business Group (HIBG), popularly known as Heera Gold, was granted bail by a local court here on Wednesday after the economic offences wing of the Aurangabad city police failed to file chargesheet within the stipulated time of 60 days.Shaikh has police cases in Pune, Thane, Byculla (Mumbai), Malegaon in Nashik, Hyderabad, Kochi, Chittod and Tirupati. So far in these cases, she has got an anticipatory bail in Kerala, regular bail in Pune and Aurangabad.Additional sessions judge VV Patil ruled, ‘The investigation team failed to file the chargesheet within 60 days from the date of her arrest, as such the accused is entitled for the bail in default.’“Under section 167(2) of Criminal Procedure Code, the chargesheet has to be filed within 60 days, otherwise the accused has indefeasible right to be released on bail. The court has warned of initiating ‘necessary action’ against the police if they fail to submit an explanation.‘The investigation officer is directed to submit his explanation as to why legal action should not be taken against him for not filing the chargesheet within stipulated period’ reads the bail order copy.The City Chowk police station, on October 21, 2018, registered an offence under sections of 420 (cheating), 406 (criminal breach of trust) of the Indian Penal Code as well as sections of the Information and Technology Act and Maharashtra Protection of Interests of Depositors (in Financial Establishments) Act, 1999 against Nowhera, based on a complaint from a retired woman teacher.The Byculla police handed her over to Aurangabad city EOW on December 14 and she remained in police custody till December 19, before being remanded in judicial custody.Bhosale said that they moved a bail application and it was readily allowed with certain conditions, including furnishing of personal bond of Rs 50,000.The regular bail she bagged in Hyderabad, was subsequently cancelled by the Hyderabad high court. The matter is pending in the apex court. Hearing of the case registered in Malegaon has been listed for hearing on February 16.
