HC notices to govt, Nanded collector over liquor ban

"The Nanded district collector ordered on March 31 to close all the shops situated 500 meters from the state or the national highways in the district in view of the Supreme Court judgment. The petition sought that the respondents "may kindly be directed to permit the petitioner to run his country liquor shop situated at Umardari in Mukhed taluka till the district road that passes through Umardari actually comes into existence as a highway. "Following the arguments, the bench comprising Justice R M Borde and Justice K L Wadane ordered issuance of notices while keeping the next date of hearing after a week, said Panpatte. "He pleaded that "Pending the hearing and final disposal of the petition, the order passed by district collector dated March 31, 2017 kindly be stayed or in the alternative, the petitioner be allowed to continue his business in the present premises upto September 30, 2017. Gaikwad approached the high court through lawyer Vilas Panpatte challenging the district collector's order while pointing out that his shop was situated on a district road, though the road was proposed by the Maharashtra State Road Development Corporation to be made a state highway.He said since the shop is still situated on a district road he should be allowed to run the business.

Aurangabad: The Aurangabad bench of the Bombay high court on Wednesday issued notices to the state government, state excise commissioner and the Nanded district collector for attempting to remove liquor establishment from the proposed state highway in Mukhed taluka in view of the recent Supreme Court verdict.The petitioner, Shriram Piraji Gaikwad (70), who runs a licenced country liquor shop at Umerdari in Mukhed talka of Nanded district argued that proposal does not mean that the highway has actually come into existence.The petitioner had referred to the Supreme Court directions which said "no shop for the sale of liquor shall be visible from a national or state highway, directly accessible from a national or state highway and situated within a distance of 500 metres of the outer edge of the national or state highway or of a service lane along the highway."The Nanded district collector ordered on March 31 to close all the shops situated 500 meters from the state or the national highways in the district in view of the Supreme Court judgment.
