Cleric plans to move SC against triple talaq ordinance

We are against jail term and are taking legal opinions from our lawyers on the matter. If any woman goes to the police station and claims that her husband has given triple talaq, the man will be arrested even if he has not uttered the three words. We will soon move the Supreme Court against criminalisation of the practice. If the ordinance would have been made keeping in mind the Sharia law, it would have been fine. However, as it has not been done, Sunni Barelvis will contest it in the court.”

Bareilly: Days after the Union Cabinet passed an ordinance making instant divorce a punishable offence with a three-year jail term, Syed Noori, chairperson of Mumbai-based Raza Academy, on Saturday said his outfit has planned to move Supreme Court against criminalisation of triple talaq.Noori, who came to Dargah Aala Hazrat in Bareilly on Saturday, said, “When the Apex Court had declared triple talaq invalid, there was no need for the Centre to bring an ordinance proposing three-year jail term. We are against jail term and are taking legal opinions from our lawyers on the matter. We will soon move the Supreme Court against criminalisation of the practice. If any woman goes to the police station and claims that her husband has given triple talaq, the man will be arrested even if he has not uttered the three words. We feel that the ordinance can be misused.” Though the ordinance has a jail term of three years, it also has the provision of bail by magistrate after the victimized wife has been heard.Maulana Shahbudin Razvi, national general secretary, Tanzeem Ulama-e-Islam, a Sunni Barelvi organisation, said, “The ordinance will create differences among people who follow the Islamic law and the law of the land. If the ordinance would have been made keeping in mind the Sharia law, it would have been fine. However, as it has not been done, Sunni Barelvis will contest it in the court.”
