Shivraj Singh Chouhan govt set to amend 60-year-old land records Act

Minister for revenue Uma Shankar Gupta described the move as 'revolutionary’.“A lot of changes have come after the enactment of the Land Records Code nearly 60 years ago.” Uma Shankar Gupta said. “Those living for years on that property will be given `bhuswami (land owner) certificates’”, Gupta said. Asked how the administration will determine who is the rightful land owner, the minister said the government has an entire system worked out for it. BHOPAL: In the last session of the 14th assembly starting June 25, the Shivraj Singh Chouhan government will bring an amendment bill to alter 122 sections of the Madhya Pradesh Bhu Rajaswa Sahita 1959 (Madhya Pradesh Land Records Code). Gupta said the amendment recommendations came from 1700 applications worked on by the Bhoomi Sudhar Ayog which was appointed by the government.

Minister for revenue Uma Shankar Gupta described the move as 'revolutionary’.“A lot of changes have come after the enactment of the Land Records Code nearly 60 years ago.” Uma Shankar Gupta said. “Therefore, the cabinet on Tuesday approved making necessary changes through an amendment bill which will be presented before the House in the upcoming monsoon session next week.”After the amendment is passed in the House, a land-owner while still alive can partition or divide land owned by him for his children and relations. “Previously, land was divided among inheritors only after the death of the owner. After amendment of the Act, it would be possible to partition land and distribute while the still alive,” the minister explained after the cabinet meeting late on Tuesday evening.Demarcation of land can be done by the owner himself with the help of government licenced surveyors. “The government will give licence to such surveyors who can be engaged by land owners for demarcation. After demarcation, one copy will have to be submitted with the tehsildar. If there are differences and complaints, then an appeal can be made one time to the SDO (sub-divisional officer). A team will be sent for verification and inquiry but only for one time,” the minister said.With areas under masterplan, diversion can be done online through an application and payment of necessary fee. The online receipt of the fee will be considered as document of diversion. No other document or visits to land record offices will be required, Uma Shankar Gupta explained.“Under the new system, surveys will not be done in 30 years as before under the Bandonast (permanent settlement) system. From now on survey and surveillance of land and land records will be a continuous ongoing process,” the revenue minister said.He also added that in urban areas there are many properties where people reside in their ancestral homes but have no relevant records. “Those living for years on that property will be given `bhuswami (land owner) certificates’”, Gupta said.
