BHOPAL/JABALPUR: A case of alleged abduction and rape of a minor girl took a surprising twist in high court when the ‘rape survivor’ submitted an affidavit, saying she had no objection if the accused were given anticipatory bail.According to the prosecution, the girl had eloped with her paramour, and on returning home in Sidhi district , filed a complaint with police that the boy was a Muslim but posed as a Hindu .
She had run away with the boy to marry him but changed her mind and returned home when she came to know the truth about his identity, says the prosecution. The police registered a case of abduction, rape and illegal confinement in addition to charges under POCSO Act and Prevention of Atrocities against SC/ST Act.
“The learned counsel for the objector submits that the complainant has no objection if the applicant be granted anticipatory bail and in this regard she has already filed an affidavit which is on record,” the judge said, in his brief order, asking the counsel for the complainant to ensure physical presence of the complainant and her father and mother on the next date of hearing, February 12.
