HC stays criminal case against Sambit Patra

Jabalpur: The Madhya Pradesh high court on Wednesday stayed proceedings in the criminal case registered against BJP national spokesperson Sambit Patra. Following a probe, Khade had asked the MP Nagar police to register a case against Patra and Uppal, who had acquired permission for the press conference under Section 188 of the IPC.The court of chief judicial magistrate had granted bail to Patra in December 2018. A chargesheet against Patra and another BJP leader SS Uppal was presented in the court on Wednesday under section 188 of the Indian Penal Code for alleged violation of the model code of conduct during the run up to the assembly polls. Patra’s counsels Purshendra Kaurav and Namrata Agrawal argued that the police FIR against him was uncalled for and was beyond their jurisdiction and that the case under section 188 IPC can only be registered on the complaint directly made to the court by the concerned officer whose directions are violated.Justice JP Gupta heard the argument and stayed proceedings against Patra in the CJM court at Bhopal. A case was registered against Patra and BJP leader SS Uppal at the behest of district collector Sudam Khade for alleged violation of the model code of conduct, following a complaint by Congress leader J P Dhanopia.He had lodged a complaint alleging that Uppal had permission to hold a press conference at MP Nagar Zone -1 between 1pm to 3pm, but they addressed the conference at the venue (outside the National Herald building at 12pm) in October 2018.Dhanopia said that he not only caused public inconvenience by his act but also violated the model code of conduct by preponing the press conference without requisite permission of the district electoral officer (the district collector).
