Bhopal: Madhya Pradesh water resources minister Narottam Mishra has moved the Gwalior bench of Madhya Pradesh high court seeking a stay on his disqualification by the Election Commission in an alleged paid news case dating 2008.Mishra was disqualified by the EC on June 23 for filing wrong accounts of election expenditure in the 2008 assembly polls.Meanwhile, former Congress MLA Rajendra Bharti who lost to Mishra in 2008 elections from Datia and was the complainant in the paid news case, also filed approached the high court with a petition for a caveat pleading the minister should not be given any relief in the case.The case would come up for hearing on Thursday. So, I requested the commission to publish the notification for re-poll as soon as possible," Bharti claimed."We filed a plea for caveat before the MP high court and are opposing any interim relief to the accused minister," Bharti's laywer Pratip Bisoria told TOI.As laid down under Section 7(b) of the Representative of the People Act, 1951, Mishra stands debarred from being member of either Houses of the state legislature and also from contesting polls for three years from the date of issue of the disqualification order.He can no longer be a member of the state cabinet in view of EC disqualification and will not be able to contest the 2018 assembly poll in Madhya Pradesh.Mishra then appealed to the Supreme Court to stall the EC proceedings but the top court did not grant him any relief.Last year, the poll panel questioned Mishra in Delhi about the allegations made in the disqualification petition.Section 10 A empowers EC to disqualify a candidate if he fails to submit account of his poll expenses in time and in the manner required by the Act. In Mishra's case, the money spent by him on paid news did not reflect in his poll expenses account filed with the Commission.
