The Chief Justice, however, orally observed that if he failed to appear, the court may issue bailable warrants to ensure his presence.The matter would now come up for hearing on November 1.On September 26, the court had asked Air India to file an affidavit giving complete details of their flights’ schedule on various sectors, the load factor and profitability of the flights.

The airlines shall also specify the profitability and load factor of the Chandigarh-Bangkok flight that was withdrawn in June.The Air India, however, had provided the details of only some sectors, including Delhi, Mumbai and Bhubaneswar to Bangkok.An affidavit, filed by Air India also informed the court that from April-July 2018, Air India’s Chandigarh-Bangkok flight accumulated an estimated loss of around Rs 8.79 crore while having an average seat factor of around 59%.Strongly objecting to that, assisting solicitor general of India Chetan Mittal said Air India sells only 80 seats out of total 100 seats and if the occupancy of passengers in that 80 is 65%, the flight cannot be said to be in losses. He further gave an example of Amritsar-Birmingham flight cancelled by Air India and the same flight is now going with full occupancy. The division bench comprising Chief Justice Krishna Murari and Justice Arun Palli rejected the affidavit filed by Air India and asked the executive director of the company to remain present in HC with complete record.The matter is pending before the HC in the wake of a petition filed by Mohali Industries Association seeking directions for more international flights from Chandigarh international airport
