Chandigarh: CAT notice to UT Police on plea of SI dismissed after rape complaint

The complaint was allegedly written on behalf of some other person wherein allegations of corruption and harassment were made against four officers — Kumar, along with Head Constables Ranbir and Ramesh and Constable Sandeep. The petition adds that Kumar learnt that accused Ranchit in Bitcoin scam had met Inspector Singh in Hotel Shivalik View and then he met DSP Yadav.

Central Administrative Tribunal (CAT) has issued a notice to Chandigarh Police, Union Territory senior superintendent of police (SSP), deputy superintendent of police (DSP) and an inspector over a plea by former sub-inspector (SI) Naveen Kumar (32) who has challenged his dismissal from service following rape allegations against him. The tribunal has ordered them to file reply on the next scheduled date of hearing on December 5. Kumar, who claimed his dismissal to be illegal and arbitrary, is, however, absconding. The rape case against him is registered at Sector 31 police station in Chandigarh. The petition alleges that SSP Nilambari Jagadale, DSP Rashmi Yadav and Inspector Jasminder Singh, along with the complainant, planted a false case against Kumar and dismissed him with an order passed in violation of statutory rules as it was not passed by the competent authority. As per the petition, Kumar, a resident of Sector 42 C, Chandigarh, joined the police force as assistant sub-inspector in October 2012. Since October 2015, he had been posted at Cyber Cell unit and was promoted as SI in 2017, reads his plea. Kumar alleges that his unblemished service record has been tarnished by three senior officers of Chandigarh Police in connivance with each other who are actually the corrupt officers. He goes on to accuse them of giving benefits to accused persons by taking bribe. The petition adds a case pertaining to crypto currency such as bitcoin was taken over by Inspector Singh in April-May, 2018. “Inspector Singh found that huge amount was involved and being an officer of compromised integrity started taking more than expected interest and desired the assistance of Kumar in investigating the matter. Inspector Singh had let off a co-accused in the FIR and when this was objected by Kumar, he asked for the SI’s cooperation, but the junior officer refused. Inspector Singh informed Kumar that the benefit to the accused persons is given as per the directions of DSP Yadav who, after learning of his objection, called him to her office, wherein she directed him to cooperate with Inspector Singh, but he refused to obey. Thus both the officers made (this) an ego and a prestige issue and pre-planned a conspiracy to end the career of Kumar,” alleged the petition. As per the report, Kumar was indicted of insubordination among other policemen. The petition adds that Kumar learnt that accused Ranchit in Bitcoin scam had met Inspector Singh in Hotel Shivalik View and then he met DSP Yadav. “Kumar tried to expose the connivance of accused Ranchit with the inspector. He moved a Right to Information application, seeking the CCTV footage of the hotel, but it was rejected by CITCO for the reasons best known to them and this was viewed seriously by Inspector Singh and DSP Yadav who then wanted to implicate the applicant in some false and frivolous case. So they convinced a woman complainant in a case of IT Act, that Kumar was also investigating, to register a false and a frivolous case. The woman lodged a case of rape against him, which was registered after a gap of four months of alleged incident and that there is no medical evidence to connect Kumar with the alleged offence. Within a week, SSP Nilambri Jagadale dismissed him illegally, unlawfully, arbitrarily on October 23, 2018,” reads the petition. It has been pleaded that the dismissal cannot be done without conducting a proper inquiry and disciplinary proceedings. It can only be done after affording an opportunity of hearing to the applicant and he has not been convicted in the FIR, says the plea.
