Chandigarh: Nigerian acquitted of charges under NDPS after 3 years

The accused Oneka Ikechukwu, a Nigerian native, has been acquitted from the Court of Additional District and Sessions Judge, Neerja Kulwant Kalson, from Section 20/21-61-85 of the NDPS Act. The Police then arrested them and registered a case under NDPS Act.

(Representational) THE PANCHKULA district Court have acquitted a 42 year-old Nigerian national from charges of NDPS Act after the Prosecution failed to prove the evidences against him in the Court. The accused was held with 189.96 grams of meth and 86.06 grams of heroin in 2015. The accused Oneka Ikechukwu, a Nigerian native, has been acquitted from the Court of Additional District and Sessions Judge, Neerja Kulwant Kalson, from Section 20/21-61-85 of the NDPS Act. Another accused in the case, Ozama has been declared a Proclaimed Offender in the case, after he did not appear in the Court following the trial. According to Prosecution, the case dates back to January 16, 2015, when the Panckula Police had arrested Oneka and his accomplice, Ozama at Panchkula bus stand at Sector 5, Panchkula. As per the FIR registered, the Police had received information that two Nigerians who were coming in a bus from Zirakpur to Panchkula, were carrying contraband. The Police team then reached the Sector 5 bus stand and found two Nigerians coming down from a Haryana roadways bus. The accused were apprehended and later, after taking permission from the Court, they were searched. The Police team then seized 189.96 grams of meth and 86.06 grams of Heroin from Oneka’s possession and 41 grams cocaine from Ozama’s possession. The Police also learnt that the accused had come to Panchkula to sell the contraband to their clients. The Police then arrested them and registered a case under NDPS Act. During the trial, the defense counsel, Advocate Ankur Chaudhrie argued in the Court that the accused Oneka have been falsely implicated in the case and if the Police arrested them through a secret informer then why the secret informer was not deposed in the Court, thus Police did not had any independent witness. Meanwhile, in the case, the Investigating Officer was the complainant himself but the complainant cannot be the Investigating Officer (IO) of the case. It was also argued that as per Prosecution the contraband from the accused was recovered from a bag in which they were containing the contraband, however, the Police did not produced the bag in the Court.
