US national rape: HC reserves order

CHANDIGARH: The Punjab and Haryana high court reserved its order related to US national rape case on Monday. High court is yet to decide whether to involve embassy in recording the statement of the US national rape survivor via a video conference.The victim was gangraped by two in Chandigarh in April, 2015. But the lower court directed Chandigarh police to conduct all procedure via the embassy. Later, appellate court ruled in favour of not involving embassy and matter is subjudiced with HC.The Chandigarh district court had started a trial in the case related to rape of a US National in Chandigarh on December 5, 2018. An investigation was conducted and an FIR was registered at the Sector 17 police station in February 2016.

CHANDIGARH: The Punjab and Haryana high court reserved its order related to US national rape case on Monday. High court is yet to decide whether to involve embassy in recording the statement of the US national rape survivor via a video conference.The victim was gangraped by two in Chandigarh in April, 2015. She did not come to India post the incident due to which Chandigarh police moved application in the court to record her statement under Section 164 of CrPC and conduct Test Identification Parade (TIP) of the accused through video conferencing without the involvement of the embassy as it was argued that doing so would be very time consuming. But the lower court directed Chandigarh police to conduct all procedure via the embassy. Later, appellate court ruled in favour of not involving embassy and matter is subjudiced with HC.The Chandigarh district court had started a trial in the case related to rape of a US National in Chandigarh on December 5, 2018. The court on August 28 had framed charges against a Ludhiana resident. The accused had been identified as Baldev Kumar, an autorickshaw driver. Another accused in the case is still on the run. On Monday, the HC reserved its order.The matter dates back to April 2015 when the victim had visited India on a tourist visa. She was scheduled to go to Europe. The survivor left the country less than a week after the crime was committed without registering a complaint and reached France.From there, she sent an online complaint to then Chandigarh IGP R P Upadhaya in August. An investigation was conducted and an FIR was registered at the Sector 17 police station in February 2016.
