HC restrains CMRL from acquiring school playground

The Madras High Court has restrained Chennai Metro Rail Limited (CMRL) from acquiring 3,590 square meters (88 cents) of land belonging to Good Shepherd Convent at College Road here, without first considering the objections raised by the school. The judge directed CMRL to give a personal hearing to the representatives of the institution on October 1 and consider all its objections before acquiring the lands. Suddenly, it had received a show-cause notice from CMRL on July 5, calling upon the school to explain why 3,590 square meters should not be acquired for establishing a metro station. Justice V. Bharathidasan passed the interim order on a writ petition filed by the school management, represented by its secretary Sister Mariam Kulangara.

In her affidavit, the secretary said that the institution had purchased 9.92 acres of land at Nungambakkam in 1930. At present, around 2,300 children were studying in the higher secondary school. Suddenly, it had received a show-cause notice from CMRL on July 5, calling upon the school to explain why 3,590 square meters should not be acquired for establishing a metro station. The institution submitted a detailed reply on July 18. The officials were told that the proposed acquisition would dislodge the entire primary section and deprive the entire school of the common playground. Their attention was also drawn to the necessity of a spacious playground in a convent for the overall development of the children. The judge directed CMRL to give a personal hearing to the representatives of the institution on October 1 and consider all its objections before acquiring the lands.
