Idol case: CBI 'can’t take up probe' as proposed

CHENNAI: In a major setback to the Tamil Nadu government, the Central Bureau of Investigation ( CBI ) on Tuesday informed the Madras high court that it cannot take up investigations into all the idol theft cases as proposed by the state.Relying on a communication of the CBI dated September 19, its counsel K Srinivasan submitted that “considering the large number of idol theft cases pending at various stages and also the future idol theft cases likely to come up and considering the severe shortage of manpower, the CBI will extend its full cooperation to the idol wing CID which is already investigating the cases. The CBI will support in matters of extradition of accused, issuing red corner notices and coordinating with Interpol.”Recording the submission, a division bench of Justice R Mahadevan and Justice P D Audikeasavlu asked advocate general Vijay Narayan as to why the state had issued the government order (GO) to transfer the probe to the CBI even without following basic procedures.To this, Narayan submitted that the state had received a communication from the CBI seeking details of the pending cases enabling them to decide on taking up the investigation. "But we are not informed about the present communication referred by the CBI counsel expressing inability to take up the investigation," he added.Narayan then sought a week's time to get instructions from the state and file a suitable reply.On August 1, the Tamil Nadu government passed a GO transferring all the pending and future idol theft cases to the CBI from the file of the idol wing CID.Subsequently, admitting a plea moved by advocate Elephant G Rajendran assailing the GO, the court on August 7 passed an interim order staying operation of the GO till further orders.
