TN: Doctor fined Rs 85K for medical negligence

MADURAI: District consumer disputes redressal forum (DCDRF), Madurai , has directed a doctor in a private hospital to pay Rs 85,000 as damages to a woman for medical negligence J Surya Mary of Madurai was a minor when she filed a complaint against the hospital. According to the complaint, the doctor directed a staff nurse to administer an injection and accordingly, the nurse injected it on the backside. Subsequently, she got treated in another hospital and was cured.The petitioner moved the consumer forum seeking a compensation of Rs1 lakh from the doctor for medical negligence. She approached Dr Sundara Rajan of Chandra Bai hospital in April 2009 to be treated for her throat infection. After perusing the submissions made, the DCDRF ruled in favour of the victim and directed the doctor to compensate a sum of Rs 85,000 to the woman for the mental and physical agony she underwent.

According to the complaint, the doctor directed a staff nurse to administer an injection and accordingly, the nurse injected it on the backside. However, the girl suffered severe pain after the injection was administered. After the injection, the girl noticed a wound. Later the wound got infected.She approached the doctor again. The doctor told her that an operation had to be performed.Despite two minor and one major operations by the same doctor, the wound was not healed, and the infection spread to other areas. Subsequently, she got treated in another hospital and was cured.The petitioner moved the consumer forum seeking a compensation of Rs1 lakh from the doctor for medical negligence. After perusing the submissions made, the DCDRF ruled in favour of the victim and directed the doctor to compensate a sum of Rs 85,000 to the woman for the mental and physical agony she underwent.
