Demolition notice served on residents of gated community

The Coimbatore Corporation has issued notice to residents of a gated community near Singanallur asking why their unauthorised construction should not be demolished. After detailing the extent of unauthorised construction, the notice also said that within three days of the receipt of the notice, the residents should explain why the notice should not be confirmed. And, in case of failure to respond within the stipulated time, the Corporation would be constrained to demolish the unauthorised construction and also recover the cost of demolition. They added that the Corporation would wait for the residents’ response thereafter decide on the next course of action. Thereafter, the Directorate asked the residents to apply afresh for approval and their failure to do so had resulted in the Corporation issuing notice, said the sources.

The Assistant Town Planning Officer-East Zone issued the notice a few days ago to each the over-100 residents of Sruthi Enclave, Kallimadai Road, Singanallur, stating that it had been brought to the Commissioner’s notice that he or she were constructing/reconstructing buildings without permission and that they should immediately stop construction and demolish the unauthorised portion within seven days. After detailing the extent of unauthorised construction, the notice also said that within three days of the receipt of the notice, the residents should explain why the notice should not be confirmed. And, in case of failure to respond within the stipulated time, the Corporation would be constrained to demolish the unauthorised construction and also recover the cost of demolition. Sources familiar with the development said that the issue was a few years old and began with the residents of the Enclave closing a water channel that passed through their premises. At the time of approval, the residents had taken a no-objection certificate from the Public Works Department to construct a causeway across the channel and not close it. After it came to light following intervention by a farmers’ association that the residents had closed down the channel, the district administration conducted an inquiry and that led to the PWD revoking the no-objection certificate. Consequent upon the revocation, the Directorate of Town and Country Planning cancelled the permission it had accorded for the Enclave, turning unauthorised all the properties therein. Thereafter, the Directorate asked the residents to apply afresh for approval and their failure to do so had resulted in the Corporation issuing notice, said the sources. They added that the Corporation would wait for the residents’ response thereafter decide on the next course of action.
