Orissa HC expresses empathy for victims of blackmail

CUTTACK: The Orissa high court has expressed empathy for victims of blackmail who fall prey to emotional blackmail , do not resist at the right time and get manipulated by fear psychosis created by the blackmailer.The empathy was writ large in a nine-page order in which the single-judge Bench of Justice SK Sahoo refused to grant bail to an alleged blackmailer on Thursday saying: "Giving a second chance to a blackmailer is like giving an extra bullet for his gun".Justice Sahoo said, "One, who falls prey to emotional blackmail, becomes a puppet in the hands of a blackmailer.

One, who does not resist at the right time, becomes the victim of repetitive harassment and exploitation. Fear psychosis is created to manipulate and paralyse the victim"."One, who screams inside the heart for suffering without a word of protest in the mouth and has no courage to face the reality of life after telling the truth to the close confidants and life partner, gives an opportunity to the shrewd blackmailer to take advantage of one's simplicity or some mistakes which he/she might have committed in the past," Justice Sahoo observed.According to the text of the order, a copy of which is in the possession of TOI, the victim of the alleged blackmail was a practising advocate of high court. Her father a senior lawyer and husband a Major in the armed forces. She had first lodged a complaint against one Avinash Tripathy with a police station in the city on May 27 last year alleging continuous harassment by him.Thereafter, Avinash was called to the police station where he apologised for his conduct and confessed his mistakes and gave a written undertaking not to indulge in any activity to defame the victim, to pay a sum of Rs 5,00,000 to the victim which he had earlier taken from the victim. He paid Rs 50,000 to the father of the victim on that day and assured to pay the balance cash of Rs 4, 50,000 by July 27, 2018.But when Avinash, on two occasions later, tried to follow the victim to create a fear psychosis in her, an FIR was lodged with the police station on July 28, 2018. She then alleged how Avinash had continuously blackmailed and extracted money from her repeatedly by using her indecent photographs and morphed photographs and threatening to ruin her marital life. He had further tried to outrage her modesty and caused continuous mental harassment by scandalizing her in public and assassinated her character.During the recording of her statements, she had alleged that Avinash had compelled her to visit places, forced her to buy expensive gifts for him and taken about Rs 12 to Rs 13 lakh from her through various means by blackmailing her on the basis of some of her indecent photographs taken without her knowledge and some morphed photographs.Subsequently, police registered a case against Tripathy on charges of criminal intimidation, cheating and assault with intent to outrage modesty along with different sections of Information Technology Act.
