'Fake' petition targeting Koraput ex-MLA angers Orissa high court

CUTTACK: A 'fake' petition aimed at preventing a BJD candidate from contesting the polls has created a flutter in the Orissa high court here.The petition, filed allegedly by way of impersonation, sought the high court's help to prevent BJD leader and former Koraput MLA Raghuram Padal from fighting the polls from the SC-reserved assembly seat. It said there was need to review the clean chit given to Padal by a state-level scrutiny committee in a 'fake certificate' case against him.Padal, who was elected from the Koraput assembly seat on a BJD ticket in 2009 but who could not contest in 2014 due to a case against him for alleged misrepresentation of caste data, has been nominated from the seat this time.The petition, filed in Koraput district on March 14, was signed by someone going by the name of Balabhadra Mandi, a resident of Mattamput under Machkund police station limits who had contested from the Koraput assembly seat on a BSP ticket in 2014 and had got 2,091 votes.When the petition came up before a single judge bench on Tuesday, Mandi appeared in court and said he had neither filed the petition nor engaged any lawyer for it. "I have never filed any such writ petition before this court. It must have been filed by some other person impersonating me for mischievous purposes," he said in an affidavit along with a miscellaneous case petition to drop the case/proceeding."Taking serious note of the matter, justice Biswajit Mohanty has posted the matter to March 29," Padal's counsel Pabitra Nayak said on Saturday.In 2009, Padal had defeated Krushna Chandra Sagaria of Congress by a margin of 1,114 votes. In 2014, he could not contest as a caste certificate case had been slapped on him then and the matter had been under inquiry. The BJD's candidate lost the seat to Sagaria that year.On November 17, 2018, the state-level scrutiny committee (SLSC) for fake certificate cases concluded that 'Raghuram Padal is Dombo by caste and Hindu by religion,' and dropped the case. The latest petition sought the quashing of SLSC order.
