HC quashes retirement order

CUTTACK: The Orissa high court has quashed the decision of a full judge bench asking a district judge to take compulsory retirement in 2012. Challenging the decision, Mohanty had moved the high court in 2013. "Though the high court has quashed the compulsory retirement decision, my client cannot be reinstated in service as his due date for retirement was in May 2017. As an administrative decision, the full bench of high court in April 2012 had recommended compulsory retirement for Subhendra Mohanty , who then worked as district judge in Boudh, after examining his performance. But the court has clearly said he will be deemed as district judge till his superannuation date in May 2017 and he will be granted all retirement benefits entitled to him," said Jitendra Lenka , one of the counsels of the petitioner.
