Court issues nonbailable warrant against business family in loan default case

Dehradun: The court of chief judicial magistrate (CJM) issued non-bailable warrants against four members of a prominent business family in Dehradun in a 2016 loan default case.Axis Bank filed a complaint of loan default against businessman Shravan Oberai and five companies promoted by Oberai family in Kotwali police station in March 2016. The family has interests in automobile sector and own multiple car showrooms in Dehradun.Gaurav Sharma, the lawyer representing Axis Bank, told TOI, “The companies owned by Oberai family took an auto loan of Rs 4.27 crore from Axis Bank. However, they failed to repay the loan and the cars kept as security against the loan were not found.”“Despite a bailable warrant and numerous notices served to the offenders, they failed to turn up, forcing the court to issue non-bailable warrant against the four family members,” said lawyer Gaurav Sharma.Besides ordering the proclamation against the offenders under section 82 of CrPC, the court also directed police to initiate proceedings of attachment of properties against the offenders under section 83 of CrPC.The family remained unreachable for comment.
