Forum dismisses plea for solatium from FIITJEE

A district consumer disputes redressal forum in Delhi has dismissed a complaint against FIITJEE institute seeking a compensation of over ?50,000. Taking into consideration submissions made by the institute, the district forum stated: “The enrolment form has been signed by the complainant and his father. Signed agreementAlleging deficiency of services on the part of the institute, as they refused to refund the money, Mr. Sharma approached the district forum demanding compensation. Therefore, the complainant is bound by the terms and conditions contained in the enrolment form. In the complaint, Mr. Sharma said he had to discontinue his course at the institute as he later took admission in a university in Lucknow.

Complainant Pratyush Sharma had alleged that he had enrolled in a one-year classroom programme for the All India Engineering Entrance Examination (AIEEE) by paying ?52,753. In the complaint, Mr. Sharma said he had to discontinue his course at the institute as he later took admission in a university in Lucknow. Signed agreement Alleging deficiency of services on the part of the institute, as they refused to refund the money, Mr. Sharma approached the district forum demanding compensation. However, the institute contended that at the time of admission, all students had to sign an agreement that included the clause that no refund would be made under any circumstance. “I understand without any ambiguity that the fee once paid is not refundable at all, whatever the reasons be,” read the clause from the enrolment form. Taking into consideration submissions made by the institute, the district forum stated: “The enrolment form has been signed by the complainant and his father. Therefore, the complainant is bound by the terms and conditions contained in the enrolment form. The complainant is not entitled to claim the amount of fee.”
