However, few minutes after the arrest, she was released on bail, they added.Ms. Diksha was first arrested on the day of the accident, the police said. “We recorded the statement of other two women who were present inside the car at the time of the accident under CrPC Sections 161 and 164 before the magistrate and she was arrested,” Aslam Khan Deputy Commissioner of Police (North-West) said. During the investigation, the case has been converted from IPC Section 304A (causing death by negligence) into IPC Section 304 (punishment for culpable homicide not amounting to murder), they added. During the course of investigation, several facts were unearthed after which the section was revised, Ms. Khan said. ‘Hid original identity’ Ms. Diksha was also charged for misleading the police after the incident by concealing her original identity and address, the officer said. She had claimed that the accident was triggered by another car ramming their SUV, she added. Ms. Diksha did not have a valid driver’s licence, the police said, adding that her learner’s licence had expired a few months ago. As per her medical report, the liquor percentage in her blood was four times the permissible limit, the police said. Parents of Ritesh (the deceased) questioned the role of police as the accused driver again managed to secure bail for herself. “I have lost my brother who was the only son of his parents. We are running pillar to post to get him justice but the accused is using the system as per her convenient and again she managed to get bail on the grounds of examinations. The investigating officer refused to take the custody and she was bailed out. We will be meeting senior police officers over the matter,” cousin of Ritesh, Pradeep Maan, said. “The eyewitnesses who were in the car in their statement said that Ms. Diksha wanted to drive the car but Ritesh had denied her the permission as she was drunk.
