HRERA orders probe into ‘fraud’ by real estate developer

The HRERA said a criminal case may filed in connection with the alleged fraud. The complainant said the promoter issued an advertisement in a Hindi daily on January 16, 2016, inviting applications for the project. The companies are accused of selling a non-existent residential project in Sector 2 on Sohna Road to multiple buyers.

The companies are accused of selling a non-existent residential project in Sector 2 on Sohna Road to multiple buyers. The HRERA said a criminal case may filed in connection with the alleged fraud. Complaint The matter came to light after Sanjay Yadav, a resident of Sector 46, appeared before the HRERA seeking fulfilment of obligations by Supertech Limited as per the Real Estate (Regulation & Development) Act, 2016, in connection with its high-rise independent floors project called ‘Officers Enclave’. The complainant said the promoter issued an advertisement in a Hindi daily on January 16, 2016, inviting applications for the project. He booked a flat a month later through Investors Clinic. In June 2017, a representative of the promoter told the complainant that the project was not going to happen and asked him to shift to some other unit in any of the other projects as per the price slab of the chosen project. The complainant asked the representative to give this in writing but the representative refused to do so. ‘Not registered’ During the hearing, the counsel for the promoter told the HRERA that the project was not registered. The counsel said neither did the promoter have permission for construction from the authority nor had the building plans been approved. The HRERA said in its order that it appeared the promoter booked many flats for similarly situated buyers with a view to cheat the complainant as well as other buyers. Saying that it was a violation of several sections under the RERA Act, the authority said in its recent order: “It is a very sad state of affairs that in spite of adjourning the matter two-three times, the respondents have not only failed to provide information about the project but also tried to mislead the authority.” The authority has appointed HCS, Executive Secretary, HRERA (Gurugram), Varinder Choudhary as the enquiry officer to investigate the whole matter while exercising powers under Section 35 of the RERA Act, 2016, and directed him to submit the report within 30 days. It also ordered refund of the entire amount to the complainant along with prescribed rate of interest within a period of 45 days and said that a show-cause notice would be issued to Investors Clinic for cancellation of its registration certificate.
