more-in Holding the Delhi Development Authority (DDA) deficient in services for delay in transfer of ownership of a flat in Rohini, the National Consumer Disputes Redressal Commission (NCDRC) has upheld the orders of the lower forum directing compensation of ?1 lakh to the flat buyer. ‘Dual suffering’ Dismissing the review petition filed by the DDA against directions of a lower forum, and noting that the transfer should be done within 60 days, the NCDRC said: “We are convinced that this is yet another case of an individual suffering in the hands of bureaucratic inefficiency, indifference and apathy. This is a very simple case of transfer of flat within the members of a family, clearly covered by the guidelines of the DDA.” The complainant had stated that despite applying for transfer of flat ownership in 2001, the process had been delayed till 2006. It was also alleged that the urban body demanded further deposits from the complainant, owing to the delay. Relevant documents The land-owning body, however, contended that the additional amount was required as the complainant failed to submit relevant documents. “The complainant objected to the additional demand, contending that his mother applied for transfer of flat in his favour, duly submitting all the requisite documents, but the petitioner took five years to effect the transfer on various pretexts,” read the complaint in the order. Upholding orders passed by the district and the State consumer forum, the NCDRC said: “The petitioner [the DDA] is clearly responsible for all delay that has occurred so far.
