Defamation case: AAP leaders’ plea dismissed

The defamation case is in relation to the alleged corruption in DDCA when Mr. Jaitley was heading it. A Delhi court has dismissed a revision petition filed by AAP leaders Sanjay Singh and Ashutosh against framing of charges against them in a criminal defamation case filed by Finance Minister Arun Jaitley. No notice to partiesCounsel for Mr. Jaitley, Manoj Taneja, said that the petition was dismissed even without issuing notices to the parties — Mr. Jaitley and the Delhi government. The two AAP leaders, in their petition, argued that they defamed the family members of Mr. Jaitley, therefore, the complaint should have been filed by his family members. Thus, Mr. Jaitley has no locus standi to file the complaint.

Thus, Mr. Jaitley has no locus standi to file the complaint. Also, there was no evidence against the petitioners to substantiate the allegations made in the complaint, and Chief Metropolitan Magistrate Sumit Dass had framed notice (charges) as per the allegations made in the complaint, but they do not constitute any offence, the leaders further submitted. ‘No illegality’ Dismissing the petition, Additional Sessions Judge Rakesh Pandit said: “From the perusal of pre-summoning evidence and the related documentary evidence, it appears that the statements given by revisionists are directly against the complainant, including with respect to their family members...,” “So, in these circumstances, I do not find any in-correctness, illegality or impropriety in the trial court proceedings/framing of notice...,” the Judge said.
