SC stays Triple Talaq for 6 months; asks Parliament to formulate law

The much awaited verdict in Triple Talaq has come. The Supreme Court has pronounced its order. The Supreme Court has put a stay order on the Triple Talaq for next six months. At the same time the Court has asked the Government to formulate a law in this regard. While reading the order, the bench said it’s the duty of Parliament to constitute a law.

At the same time the Court has asked the Government to formulate a law in this regard. While reading the order, the bench said it’s the duty of Parliament to constitute a law. However, the court said if Parliament fails to bring the law then Court will step in.  A five-judge Supreme Court bench has barred the controversial Triple Talaq practice, asking the Centre to bring legislation. The apex court put a six-month stay on the practice, directing Parliament to enact a law within the given time period. 

Triple Talaq is a form of divorce followed by Muslims in India. It has been at the centre of the controversy for a long period, raising questions of human rights, secularism and gender justice. This practice is seen by a section of Muslims as regressive and many complaints have been lodged, citing how unjust the whole practice is towards women. Proponents of the Uniform Civil Code have often raised the issue and how it tends to go against the basic human rights.
