Apartment owners’ association reinstated in Raj Nagar Extension society

GHAZIABAD: The office of the deputy registrar of firms, societies and chits has revoked its former order and reinstated the Apartment Owner’s Association (AOA) of K W Srishti Society located in Raj Nagar Extension . Indoliya said, “The association was registered at the deputy registrar’s office in March 2016. Later, the deputy registrar’s office received complaints against the AOA in which it was alleged that it was formed without following the norms and regulations. “The one-sided order has been given by the deputy registrar under pressure of an AOA member. We still say that there 1, 468 flats have been approved by the GDA,” the official added.

In June 2016, the deputy registrar’s office passed an order to scrap the AOA but it has now stated that the private developer not only submitted false documents related to the residential colony to its office, but also tried to dissuade other members from joining the AOA. It has also been stated that the developer tried to frame the AOA members in court cases to ensure that the organisation was not formed.The registrar’s office said the residents followed all the rules and regulations of the UP Apartment Act necessary for the formation of the AOA.Soon after the cancellation of the AOA in 2016, its general secretary Aahuti Indoliya had approached the then divisional commissioner challenging the deputy registrar’s order and subsequently an inquiry was conducted. It was found that the developer had been submitting false documents. Indoliya said, “The association was registered at the deputy registrar’s office in March 2016. Later, the deputy registrar’s office received complaints against the AOA in which it was alleged that it was formed without following the norms and regulations. Subsequently, the registrar’s office cancelled the approval in May 2016.”The builder had stated that the condition of the 33% occupation of total flats in the residential colony that is required for the formation of the AOA, was not fulfilled.According to the builder, 1, 468 flats were built by August 2015. It also submitted a list of 84 residents with their signatures stating that they did not get an opportunity to cast their votes in the election.The AOA countered the builder’s claim and said GDA had passed the map of 998 flats and not 1, 468 when the association was formed, and against the requirement of 329 flats, 365 were given possession.The deputy registrar also observed that the signatures of 84 residents were forged and many signatures were repeated twice and thrice.“In January 2018, an order was passed by commissioner in which the deputy registrar was asked to give an opportunity to the two parties to present their arguments and then once again pass an order based on the inquiry,” Indoliya said.A senior official of K W Group, said the company would appeal against the deputy registrar’s order in the Allahabad high court. “The one-sided order has been given by the deputy registrar under pressure of an AOA member. We still say that there 1, 468 flats have been approved by the GDA,” the official added.
