SC to D P Yadav: if not fit for surgery, go back to jail

"You get over your viral fever and get tested for fitness to undergo surgery. If you are fit, then let the doctors perform surgery. "We had desired the doctors in the hospital, after completion of pre-operative checks, should certify as to whether the accused petitioner is in a fit condition for surgery..." Justice Gogoi warned Yadav not to take advantage of the order. The bench said it had on September 18 granted interim bail for 15 days to Yadav to enable him to get admitted in the hospital.

NEW DELHI: The Supreme Court on Tuesday acted tough on politician D P Yadav , convicted in the 1992 murder of a Ghaziabad MLA and facing life term while his appeal is pending in the high court, when he attempted to take advantage of the court's earlier order for his hospitalisation for 15 days by seeking an extension of his stay in the hospital.Yadav, whose son Vikas was sentenced to 25 years in prison in the Nitish Katara murder case , through senior advocate Rameshwar Singh Malik pleaded with a bench of Chief Justice Ranjan Gogoi and Justices Sanjay K Kaul and K M Joseph that he needed to extend his stay in the hospital as requisite tests to determine his fitness to undergo surgery could not be completed because he suffered from viral fever.The bench examined the medical documents and asked, "What kind of viral fever is it that the doctors prescribed only paracetamol tablets for you?" Justice Gogoi warned Yadav not to take advantage of the order. "You get over your viral fever and get tested for fitness to undergo surgery. If you are fit, then let the doctors perform surgery. If not, then you go back to jail," he said.
