Grades, e-courts and conciliation forums on UP-RERA’s to-do list

Complainant will file online complaint at UP RERA website after which UP RERA secretary will shortlist the complaints and will through development or industrial authority of the concerned area will contact the builder against whom the complaint have been made.

GHAZIABAD: The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) which came into effect in the state last year is evolving itself to suit to needs of home buyers and promoters alike. In Ghaziabad Development Authority’s awareness workshop on RERA which was held on Saturday, UP-RERA secretary Abrar Ahmed gave a glimpse of what RERA will offer in days to come. In the workshop which was attended by home buyers and promoter’s representatives, Abrar sought to bring clarity on RERA and said that it is committed to protect the interest of home buyers in the state.In its effort to add more teeth to RERA Abrar said that authority is in the process of introducing grading system of promoters and their projects. “Based on the kind of work done by any promoters we will award grades to their projects so that a prospective home buyer before investing in that project will have a before hand knowledge of the reputation of the promoters, that way the will have the advantage of choosing projects and promoters with good grades” said Abrar Ahmed, secretary, UP-RERA. The grading will be primarily based on feedback of people who ave been associated with the project and how compliant they the projects and promoters are with the RERA rules.Ahmed also said that e-courts will be instituted for redresal of home buyers complaints and for that a mobile application will be introduced shortly. “There have been instances when it becomes very difficult to track individual cases/complaints registered with RERA, so a mobile App will be introduced shortly so that complainants could track the status of case without bothering to visit RERA office” said Abrar.The secretary also informed till date there are about 9000 complaints registered with RERA and out of which only 2500 have been disposed. “Given the magnitude of complaints we are faced with the problem of timely disposition of cases so we are instituting conciliation forums across states which will take care of cases which could be solved amicably, this way it will take some of the loads off our back” said Ahmed.The composition and working of the forum was discussed threadbare. The 11-member forum will comprise of 5-members from RWAs, 5-members CREDAI and one member from development or industrial authority. Complainant will file online complaint at UP RERA website after which UP RERA secretary will shortlist the complaints and will through development or industrial authority of the concerned area will contact the builder against whom the complaint have been made. A mutually agreed date and time will be fixed for developer and builder to appear before the 11-member forum in their respective jurisdiction.In regards to rights and obligation of allottes/home buyers Abrar said that provisions of RERA gives allottes right to form allottes association who at any given time physically verify the progress made on a project.On the occasion home buyer and promoters representatives also came up with suggestions and problems faced and sought form Ahmed to consider it. Gaurav Gupta, general secretary, CREDAI, Ghaziabad said that delay or stoppage of work on account of NGT ban on construction or due to other local issues should be accounted into when project fails to meet deadline. “Stoppage of work on a project due to local factors for even a week pushes back project back to many months so these factors needs to be factored it when project fails to meet deadline or completion date” said Gaurav Gupta, general secretary, CREDAI, Ghaziabad.Fed AOA president Alok Kumar suggested that word count on complaint section on the website should be increased. “Many a times in 300 word limit count the exact nature of complaints could not be properly addressed” said Kumar.
