Madrasa principal accused of raping 13-yr-old student last yr acquitted

Ghaziabad: A Pocso court in Ghaziabad acquitted a 30-year-old madrasa principal of rape charges. He was accused of raping a 13-year-old student in Masuri in 2022 on the pretext of giving her extra lessons in the evening. However, the complainant, the victims mother, turned hostile during the trial, and the medical report did not establish rape.In the complaint filed at Masuri police station on November 10, 2022, the victims mother said, "My daughter studied in Class 6 at the madrasa. She had become quieter. When I questioned her, she said the school principal used to make her stay after recess on the pretext of giving her extra lessons and sexually assaulted her."At the time, the complainant also said the principal raped her several times in two months. Police filed an FIR and arrested the accused on the same day. Later, they produced him in court and sent him to judicial custody.A chargesheet was filed on December 12 last year, and the charges were framed against him in court on January 6 this year. The accused denied the charges and decided to face trial.However, during trial, the complainant turned hostile and said the accused had not raped her daughter. He had not raped my daughter… I had just signed a paper, and someone filed a police complaint, she told the court. The medical report showed no bleeding or injuries on the victims body. The forensic examination of samples from the victim showed no spermatozoa during a DNA profiling.Hasmat Ali Abbas, the accuseds lawyer, also said that his client should be freed as there was no evidence against him.Harshvardhan, special judge (Pocso Act), on Tuesday said that the prosecution had failed to prove the accuseds involvement in crime beyond reasonable doubt and acquitted him from charged under IPC sections 376 (3) (sexual intercourse by a person in authority) and 506 (criminal intimidation) and Section 5/6 of Pocso Act. Printouts of Facebook messages were submitted, which showed that the complainant was keen on having a sexual relationship.
