Suspension order against Serula attorney

Lobo had challenged the notice issued under article 350 of code of comunidade before the high court of Bombay at Goa. Further, he argued that the attorney had acted in a bonafide manner after seeking legal advice, which had concluded the NOC could be issued. The mutation was aimed at granting occupants status to the private person, who had claimed that the property was granted as an aforamento. Panaji: Administrator of comunidade, north zone has issued an order suspending Agnelo Lobo, attorney of Serula comunidade for his failure to protect the comunidade’s interest in granting a no objection certificate (NOC) to the mutation of 39,000 sqm of land involving a private person.The order follows a show cause notice issued by the administrator of comunidade, north zone, Gaurish Shankhwalkar against Lobo for his removal or disqualification on August 1, 2018. But Shankwalkar in his order pointed out that he had powers to issue notice or take action against the attorney under article 74 of the code.Further, the NOC has been granted without verifying details of the property, and that the applicant’s documents pertain to the survey number for which he claims aforamento rights, the order stated.

Lobo’s as well as the managing committee’s term ends shortly, and the charge against Lobo was that he granted approval for mutation of comunidade land based on documents, which are records before the survey came into effect.At that time, land records didn’t have survey numbers but lote numbers. The mutation was aimed at granting occupants status to the private person, who had claimed that the property was granted as an aforamento. Lobo had challenged the notice issued under article 350 of code of comunidade before the high court of Bombay at Goa. But the court remanded the matter back to the administrator for fresh hearing and passing necessary orders.An advocate arguing on Lobo’s behalf denied all contentions and stated that the administrator has no jurisdiction to issue the notice. Further, he argued that the attorney had acted in a bonafide manner after seeking legal advice, which had concluded the NOC could be issued. But Shankwalkar in his order pointed out that he had powers to issue notice or take action against the attorney under article 74 of the code.Further, the NOC has been granted without verifying details of the property, and that the applicant’s documents pertain to the survey number for which he claims aforamento rights, the order stated.
