Haryana Roadways fined for cancelling bus service

CHANDIGARH: Not having a system in place to inform passengers about cancellations, if any, of their advance booking or of buses has cost Haryana Roadways dear. Terming it as deficiency in service, the district consumer disputes redressel forum Chandigarh has directed the roadways authorities to pay a passenger Rs 2,000.The complainant, Sandeep Bhardwaj of Sector 23, had alleged in his complaint that on April 9, 2017, he had made online booking at Haryana Roadways portal in advance from Gurgaon to Chandigarh.His seat number was confirmed and the journey was scheduled for April 11, 2017, at 3:30am and accordingly he reached Gurgaon bus stand and kept on waiting. Later on it was informed by police officials that bus will not operate as there was a strike going on from April 10, 2017. As a result, he had to rush to Chandigarh in a private vehicle costing him more money.Contesting the allegations, Haryana Roadway authorities stated, “Without any prior notice, from April 10, 2017 evening there was a strike of the roadways employees that was settled on April 13, 2017.”It was also shared that the amount of Rs 680 was refunded to the complainant after a few days.After hearing both sides, the forum observed that the amount of the ticket was refunded to the complainant on April 27, 2017 that is subsequent to the proceedings. It further held that there were two reasons for penalising the roadways. “First, the management never goes on strike. It was a case of online booking on April 9, 2017, and the management could have given intimation on the passenger’s mobile phone regarding cancellation of bus service. Secondly, the amount was refunded after 17 days.”“As per pleadings of the parties, the fact cannot be ignored that due to cancellation of the bus on account of strike, inconvenience was caused to the complainant, which is writ large.”The forum then directed the roadways to pay Rs 1,000 as compensation for deficiency in service and mental agony and harassment caused to Bhardwaj and also to pay Rs 1,000 as litigation charges.
