Ambala: Rs 5 lakh compensation to minor rape survivor

Accordingly, in the interest of justice, an amount of Rs 5 lakh is awarded as compensation for the rehabilitation of the victim.” AMBALA: The district legal services authority ( DLSA ), Ambala has ordered a compensation of Rs 5 lakh to a minor rape survivor, while the district court has awarded rigorous imprisonment of 10 years with a fine of Rs 20,000 to the convict Ram Avtar (60), a resident of village Boh here in Ambala Cantonment under Section 6 of the Protection of the Children from Sexual Offences (POCSO) Act.In case of non-payment of the fine, the convict would have to undergo additional simple imprisonment of two years.On November 27, 2017 Ram Avtar had sexually assaulted a minor girl, following which the Ambala women police had registered a case of aggravated penetrative sexual assault against him.The cops said that at the time of crime, the age of the survivor girl was nearly three and half years.The accused Ram Avtar has been prosecuted on the basis of statement given by the survivor’s mother before the police.The case went under trial in the court of additional district and sessions judge Yashwinder Paul Singh and the accused was held guilty under Section 6 of the POCSO act vide judgment dated January 5, 2019.On January 7, 2019, the case was forwarded to the DLSA for exploring the possibility of compensation under the Haryana Victim Compensation Scheme (HVCS), 2013.On January 8, 2019, an application under Section 357-A of the Code of Criminal Procedure (CrPC) was moved to the DLSA by the parents of the survivor girl.DLSA officials said that following due procedure, it was found that the annual income of the survivor's family was Rs 99,000, less than Rs 4.5 lakh per annum, which is one of the conditions before payment of compensation.Chief judicial magistrate-cum-secretary of Ambala DLSA said, “The case was reported within 48 hours of the occurrence of the crime to the police and the victim, who is a minor, has suffered a lot of agony and pain during all these years.
