HC notices to AP, Telangana on shortage of PPs in courts

The Chief Justice observed that assigning the works and cases related to two or three courts to a single public prosecutor was, apparently, overburdening them. As per the instructions of the Chief Justice to the HC registry, the matter was taken up as two petitions — one referring to Telangana and the other to Andhra Pradesh. ‘Accused remain accused’Naturally, there was a need to appoint adequate number of PPs in all the trial courts to present foolproof arguments against the accused and secure their conviction, the Chief Justice noted. In some cases, the accused were remaining the accused for several years without being tried for the charges pressed against them, the bench said. This was hampering extension of justice to the victims and slowing down the process of prosecution.

more-in Expressing concern over piling up of cases in criminal courts in the two Telugu states of Telangana and Andhra Pradesh, the Hyderabad High Court had taken up suo motu the issue of inadequate number of public prosecutors as Public Interest Litigation (PIL). A division bench comprising Chief Justice Thottathil B. Radhakrishnan and Justice V. Ramasubramanian recently issued notices to the Union Ministry of Law and Justice, along with the Chief Secretaries, Directors-General of Police, Directors of Prosecution and Legal Service Authorities of the two States on the matter. The Chief Justice observed that assigning the works and cases related to two or three courts to a single public prosecutor was, apparently, overburdening them. Quality of the prosecution and presentation of the arguments too was eroding, he observed. ‘Accused remain accused’ Naturally, there was a need to appoint adequate number of PPs in all the trial courts to present foolproof arguments against the accused and secure their conviction, the Chief Justice noted. In some cases, the accused were remaining the accused for several years without being tried for the charges pressed against them, the bench said. As per the instructions of the Chief Justice to the HC registry, the matter was taken up as two petitions — one referring to Telangana and the other to Andhra Pradesh.
