The verdict by Justice D Y Chandrachud and Justice M R Shah pronouncing the release of a political activist in Manipur, Leichombam Erendro, reaffirms that India still rests on constitutional democracy.
The doubting Thomases who refuse to believe that, in our country, each one of us has the right to place our point of view, must read the judgment.
Erendro’s fault was that he wrote in social media that, ‘cow dung and cow urine do not work’. However, Erendro said this while commenting on the untimely death of the state BJP president.
Perhaps, the BJP leader had made claims about a foolproof cure of anything through dung and urine as stated above.
In their judgment on July 17, the two learned justices were far from being doubting that, the arrest of Erendro on charges of ‘ sedition “ is a fraud on the constitution “.
It has set a new parameter. The development points at the difference between the priorities of those who rule and of those who do not agree with and raises questions.
But in today’s politics, tolerance towards such dissents is seldom noticed. Rather it sometimes faces reprisals in one form or the other. Like in the case of Erendro.
When the entire world remains under the shadow of ignorance, as regards the ongoing pandemic, despite the advanced science which has breached the barriers into space, one can well compare between what the BJP legislator had claimed and what Erendro meant to say in through his social media message.
One has to differentiate between faith and bigotry. It was a light comment from Erendro, not an aspersion on any faith but, certainly a jibe at an often perpetuated bigotry.
However, justices such statements from….Nor was it an attack on any political establishment which nowadays dubbed as ‘anti-national’. At the best, we can stretch it as a tongue-in-cheek sort of one-liner.
However, the two judges have boldly deciphered the fine line between what the establishment of rule wants and what the people have the right to react to.
